ARTICLE 13 – CONTROL OF USE

January 2020, the use of fluorinated greenhouse gases, with a global warming potential of 2500 or more, to service or maintain refrigeration equipment
with a charge size of 40 tonnes of CO2 equivalent or more, is prohibited. From 1
st
January 2025, it is planned to extend this ban to all refrigeration systems
regardless of the refrigerant charge.
In accordance with Article 13 Paragraph 3 Subparagraph b), until 1
st
January 2030 recycled fluorinated greenhouse gases with a global warming potential of 2500 or
more contained in refrigeration equipment with a load size equal to or greater than 40 tonnes of CO2 equivalent may be used for the maintenance or repair of existing
refrigeration equipment, provided they have been recovered from such equipment.
Such recycled gases may only be used by the undertaking which carried out their recovery as part of maintenance or servicing or the undertaking for which the recovery was
carried out as part of maintenance or servicing. Regulation (EU) No. 517/2014 Article 2 point 15 and the new Regulation Article 3 point 12 define ‘recycling’ as the re-use of a
recovered fluorinated greenhouse gas after a basic cleaning process.
